A binding Massachusetts sublease agreement must clearly indicate the terms of the lease. It should also explain the implications of termination of the master lease before the term ends.
Commencement Date
The "Commencement Date" of this Sublease Agreement shall be the date on which the Sublessee takes possession of the Subleased Premises and commences its use and occupancy, which is currently anticipated to be (Insert Date).
Termination Date
Termination by Sublessee.
The Sublessee may terminate this Sublease Agreement by providing the Sublessor with written notice of termination at least 30 days in advance of the intended termination date.
Termination by Sublessor.
The Sublessor may terminate this Sublease Agreement by providing the Sublessee with written notice of termination at least 30 days in advance of the intended termination date.
Termination of Master Lease
Termination by Master Landlord.
In the event that the Master Landlord, under the terms of the Master Lease, terminates or elects not to renew the Master Lease, this Sublease Agreement shall also terminate as of the same date as the Master Lease termination. The Sublessee shall vacate the Subleased Premises in accordance with the terms of the Master Lease. The Sublessee shall have no claim against the Sublessor or the Master Landlord as a result of the termination of this Sublease Agreement due to Master Lease termination, except as expressly provided in Master Lease or as required by applicable law.
Eviction by Master Landlord.
If the Master Landlord exercises any rights or remedies under the Master Lease that result in the eviction of the Sublessee from the Subleased Premises, this Sublease Agreement shall terminate immediately. The Sublessee shall have no further rights or claims against the Sublessor except as expressly provided in the Master Lease or as required by applicable law.
