1. Term of Agreement

The Fixed Term Lease (the "Term") begins on (Date) ("Start Date") and ends on (Date) ("End Date").

At the end of the Term: Month-to-Month Lease.

The Landlord will create a month-to-month holdover tenancy. If the Landlord accepts a rent payment from the Tenants other than past due or additional rent, then after the Term expires, the Parties understand the month-to-month holdover tenancy applies at agreed-upon monthly rent unless proper notice has been served as required by applicable laws.

2. Rent

Tenants agree to pay $(Rent.Amount) for the Property and such payments will be made (after the initial payment due on the signing date) on or before the first day of each month. If the Start Date is on a day other than the first day of the month, rent will be prorated for the first month.

If payments are sent by mail, the Tenants must send it in advance of the due date to ensure delivery on or before the first day of the month.

3. Security Deposit

Tenants will pay the Landlord a security deposit of $(Deposit.Amount) on the day this Agreement is signed. The Landlord is not required to keep security deposit funds in a trust account nor pay any interest on it unless required by law.

Within (Number.Days) days of the termination of this Agreement (and Tenants vacating the Property), the Landlord will provide the Tenants with an itemized statement showing any retentions of any portions of the security deposit amount for the cost of cleaning or repair above and beyond ordinary wear and tear on the Property or any other sums due to the Landlord under this Agreement. Tenants cannot treat the security deposit as part of any rent payment.

4. Returned Check Charges and Late Fees

Rent payments returned for insufficient funds, a "stop payment," or any other reason will incur a returned check charge of (Charge). Late fees of (Fee) per day will apply beginning on the 5th day of each month if the payment is not made in a timely manner or the maximum amount authorized by law.

5. Move-in Payments Due

Upon the date of signing this Fixed Term Lease Agreement, the following payments are due and before the Tenants move into the Property:

6. Occupants

7. Insurance

Tenants are responsible for insurance and provide the Landlord with proof thereof.

8. Maintenance

Tenants will maintain the residence in a clean and sanitary condition, inside and outside of the Property, including the following:

Tenants will promptly notify the Landlord in writing of any damages, problems, or malfunctions to the Property, landscapes, and appliances. The Landlord will take reasonable corrective action. If the Tenants caused the issues or their invitees or guests, and not reasonable wear and tear on the Property, the Landlord reserves the right to require the Tenants to bear the repair costs.

Tenants are not permitted to make any modifications to the Property, such as nails in walls, painting, or other changes that would alter the condition of the Property beyond ordinary wear and tear.

9. Utilities

The Landlord will provide the following utilities for the Property: (List the utilities the landlord will cover)

10. Keys

The Landlord owns the keys to the Property, not the Tenants. The Tenants are not permitted to make any copies thereof. If additional keys are required or lost, the Tenants must arrange to obtain them from the Landlord at an additional cost to the Tenants. The Tenants will return the keys to the Landlord upon the termination of this Agreement.

11. Quiet Enjoyment

Tenants will be respectful of the neighbors and the community where the Property is located and not create excessive noise or nuisances, nor will any illegal conduct be carried out on the premises. Commission of criminal conduct on the Property will be grounds for immediate termination of this Agreement and an obligation for the Tenants to vacate the Property immediately.

12. Termination

If the Tenants fail to comply with the terms in this Agreement or misrepresent any material fact on the Tenants' rental application, the Landlord can terminate this Agreement with written notice to the Tenants and procedures by law.

If this Agreement is on a Fixed-term basis (as indicated in section 1), this Agreement will terminate at 11:59 pm on (Date). If Tenants do not vacate the property at that time, this lease will convert to a month-to-month tenancy, and all other terms of this Agreement will remain in full force and effect.

If this Agreement is on a month-to-month basis (as indicated in section 1), the Landlord or the Tenants may terminate this Agreement by providing no less than 30 days advance written notice of intention to terminate.

13. Rights of Access

The Landlord or agents are permitted to access the Property in the event of an emergency without prior notice or with at least (Days) advance written notice for any other purpose, such as to make repairs.

14. Assignment or Subletting

Tenants cannot assign this Agreement to any other person without advance written consent from the Landlord. The Landlord may, however, transfer this Agreement to a new property owner if the Property is sold during the term of this Agreement.

16. Applicable by Law

This Agreement will be interpreted and governed by the laws of the State of (State), and the venue of any dispute over this Agreement will be in the Country of (Country) in the State of (State).

In the event of a dispute between the parties arising under this Agreement, the Parties will make good faith efforts to discuss the dispute in person and attempt to resolve it.

17. Entire Agreement

Any modifications to this Agreement will be done in writing and shall be signed by each party. There are no understandings, representations, and warranties except as herein expressly set forth, and no rights are granted except as expressly set forth herein.
