Month-to-Month Leases in Arizona
An Arizona month-to-month lease agreement is a contract that renews automatically on a monthly basis. However, either party can cancel the agreement with a month’s notice. This type of arrangement can be helpful for both the landlord and tenant when they’re unsure about the exact duration of the rental period.
Lease Termination and Renewal
- Arizona allows the landlord or tenant to terminate a month-to-month lease by giving a minimum of 30 days’ notice. It can be hand-delivered or sent via registered or certified mail.
- A month-to-month lease agreement is a rental contract that automatically renews monthly until terminated by either party with proper notice.
Rent Increases
- Landlords in Arizona must provide a 30-day notice before increasing rent on a month-to-month lease.
- As per fair housing laws, property owners or managers are prohibited from increasing the rent for discriminatory or retaliatory reasons.
- If landlords are considering sending a rent increase notice to their tenants, there are two legal methods that you can use: in-person delivery and mail delivery.
Security Deposit
- In Arizona, the security deposit cannot exceed one and a half months’ rent. It cannot include charges for cleaning or redecorating the unit.
- Landlords are required to refund the full security deposit or the remainder after deductions within 14 business days of the tenant’s move-out date.
- Landlords must provide written notice to tenants informing them that they have the right to be present during the inspection conducted at the end of the tenancy to determine any deductions from the deposit.
